✅ SUPPORT SB 262 – Full Kratom Ban (Schedule I)
Delaware is at a turning point. Lawmakers have a clear choice: regulate a problem they cannot control – or end it.
SB 262 is the only policy that actually addresses the risk. It places kratom and its active alkaloids – mitragynine and 7‑hydroxymitragynine – into Schedule I, removing these unregulated, pharmacologically active substances from gas stations, vape shops, and online markets.
This is not theoretical. These products are already associated with contamination, inconsistent potency, and documented harm. A regulatory framework does not fix that – it legitimizes it.
Lawmakers need to hear clearly and immediately: support SB 262 and end the retail sale of kratom.
❌ OPPOSE HB 332 – The KCPA Illusion
HB 332 attempts to regulate kratom through a Kratom Consumer Protection Act (KCPA) model. That approach sounds reasonable – until you look at how it works in practice.

- ❌ Easy workarounds through formulation and labeling
- ❌ Continued sale in the same retail environments – gas stations, vape shops
🔥 This is not control. It is cover. A KCPA framework does not solve contamination, potency, or access – it simply gives the appearance of action while the same dangerous products remain widely available.
Lawmakers should reject HB 332 and avoid locking Delaware into a system that cannot be enforced.
